KazTAG - Luxembourg District Court suspended the consideration of civil affairs on the suit of Moldavian businessmen of Anatola and Gabriel's Status to Kazakhstan before the end of the criminal investigation, the press service of the Ministry of Justice of the Republic of Kazakhstan reports.
"The District Court of Luxembourg rejected the petition for the extension of the temporary arrest imposed in 2017. The court ruled in favor of Kazakhstan and decided to suspend the proceedings until Luxembourg law enforcement agencies hold a complete investigation into fraud, "the report on Friday said.
It is noted that the criminal investigation in relation to the costs continues.
"Currently, a criminal investigation into the fraudulent action of the statutes in Luxembourg continues. Having considered proof of the circulation fraud, as well as various expert opinions represented by Kazakhstan, the court came to the conclusion that "one cannot exclude that the alleged fraud could affect the amount of damage to the construction of a gas processing plant." He also decided that there was a sufficient connection between the affairs of Kazakhstan on fraud and civil lawsuit in accordance with the arbitration decision against Kazakhstan, "the Ministry of Justice said.
According to the department, the experts concluded that they received an arbitration decision fraudulently.
"The court directly mentions the expert opinions of the judge of the Court of Appeal of St. Patrick Sholdstrom, Professor Christopa Creury, Professor George Bermann, the conclusion of Pricewaterhouse, as well as the former prosecutor of the United States Stephen Kasselyla. All experts came to the conclusion that they were engaged in systematic fraud when receiving an arbitration decision and continue to perform it, trying to achieve its execution. In particular, the time is greatly relying on the courts of Sweden, but the Swedish judge and expert by Scholdstrom came to the conclusion that "... there are reliable evidence that they received an arbitration decision with their actions and concealment in accordance with Swedish legislation, which are equivalent to criminal fraud" , - said in the message.
Recall, the Moldovan oligarchs Anatol and Gabriel of the Status filed judicial claims against Kazakhstan in 2010 on charges of raider seizure of their property - the Kazakhstani side of the accusation denies. At the same time, serving the assets of the National Foundation Bank-Custodian Bank of New York Mellon froze the assets of the National Foundation of Kazakhstan in the amount of $ 22 billion in December 2017.
